1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding agreement between you ("Client," "you," or "your") and Purple Cleaning ("Purple Cleaning," "we," "our," or "us"). By accessing our website (purple.cleaning and affiliated domains), requesting a quote, booking a service, or otherwise engaging with our business, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our website or services. These Terms apply to all residential and commercial cleaning services we provide in Naples, Bonita Springs, Estero, and Marco Island, Florida.

2. Services Offered

Purple Cleaning provides professional cleaning services within our designated service area. Our services include, but are not limited to:

  • House Cleaning: Routine cleaning of residential properties including dusting, vacuuming, mopping, bathroom and kitchen sanitization, bed making, and trash removal.
  • Deep Cleaning: Comprehensive cleaning including interior appliances, grout, baseboards, ceiling fans, and detailed surface cleaning beyond routine maintenance.
  • Move-In / Move-Out Cleaning: Detailed turnover cleaning for rental properties, vacant homes, and properties being sold or leased, including inside cabinets, drawers, and appliances.
  • Recurring Cleaning: Scheduled maintenance cleaning on a weekly, bi-weekly, or monthly basis with flexible rescheduling.
  • Office Cleaning: Commercial cleaning for offices, clinics, and professional spaces, including desk dusting, restroom sanitization, floor care, and breakroom cleaning.

Service availability is subject to scheduling capacity, geographic coverage, and property suitability. We reserve the right to refuse service or limit scope at our discretion. Additional services or add-ons may be available upon request and subject to separate pricing.

3. Quotes and Pricing

All quotes and estimates provided via our website, phone, or email are based on the information you provide about your property (size, condition, number of rooms and bathrooms, pets, etc.) and are subject to verification. You must provide accurate and complete information in good faith. Final pricing is confirmed at booking; however, we reserve the right to charge additional fees if the actual property condition or scope differs materially from your description—for example, if the home is excessively cluttered or you misrepresented the property to obtain a lower price. See Section 6 for payment and supplemental charge terms. Quotes may expire and do not constitute an offer until both parties agree in writing or by confirmed booking.

4. Booking and Scheduling

A booking is confirmed only when we send you a written confirmation (email or text). You must provide accurate address, contact information, access instructions, and any special requirements. You are responsible for ensuring safe and unobstructed access to the property at the scheduled time. Failure to provide access may result in a no-show fee. We will make reasonable efforts to accommodate preferred time windows but cannot guarantee exact arrival times. Appointment windows are estimates, not guarantees.

5. Cancellation and Rescheduling

Cancellations must be made at least 24 hours before the scheduled service start time. Cancellations made less than 24 hours in advance may be subject to a cancellation fee of up to the full cost of the scheduled service. Rescheduling requests should be made at least 24 hours in advance; we will accommodate when possible. For recurring clients, we require notice of at least one full service cycle before canceling or pausing service to avoid charges. We reserve the right to cancel or reschedule due to weather, emergencies, staff availability, or other circumstances beyond our control without liability.

6. Payment Terms

Payment is required at the time of online booking or reservation. We accept credit cards, debit cards, and other payment methods we make available on our website or booking platform. By completing a booking, you authorize us to charge the payment method you provide for the confirmed service amount. For recurring services, automatic billing may be used at the frequency agreed.

If the actual condition of the property or scope of work differs materially from what you described at booking, we reserve the right to charge additional fees. Such additional charges will be billed separately and are due upon notice. Situations that may result in supplemental charges include, but are not limited to:

  • The property is excessively cluttered, dirty, or in a condition that requires significantly more time or effort than a typical cleaning of the described size and type
  • You did not accurately disclose the property's condition, size, number of rooms, bathrooms, or special circumstances that affect the cleaning scope
  • You omitted or misrepresented material information about the property in bad faith to obtain a lower quoted price
  • Additional rooms, areas, or items not included in the original booking require cleaning
  • Presence of excessive pet hair, soiling, or other conditions that were not disclosed

We will notify you of any additional charges before or promptly after service and will charge the payment method on file. You authorize us to charge for these supplemental fees. Late payments may incur interest and collection costs. All prices are in U.S. dollars and exclude applicable taxes unless otherwise stated.

7. Satisfaction Guarantee

If you are not satisfied with our cleaning, you must contact us within 24 hours of service completion. We will arrange a re-cleaning of the affected areas at no additional charge. This guarantee applies only to the specific areas identified as unsatisfactory and only when you have reported the concern within the 24-hour window. The guarantee does not apply to normal wear and tear, pre-existing conditions, or issues arising from Client-provided products or instructions. We are not obligated to provide refunds; our remedy is limited to re-cleaning as described. Repeated abuse of the satisfaction guarantee may result in termination of service.

8. Client Responsibilities

You agree to: (a) provide accurate and complete information about your property, including square footage, number of rooms and bathrooms, current condition, clutter level, and any factors that affect cleaning scope; (b) secure or remove valuables, cash, jewelry, and sensitive documents before our arrival; (c) disclose pets, hazardous materials, or special conditions that could affect the cleaning; (d) ensure the property is safe for our personnel; (e) provide necessary access, keys, codes, or instructions; and (f) notify us promptly of any issues. Failure to accurately describe your property may result in supplemental charges as described in Section 6. We are not responsible for items we cannot access (e.g., locked areas) or for damage caused by pre-existing defects, improper surfaces, or Client-provided equipment or products.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PURPLE CLEANING AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO OUR SERVICES OR WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Purple Cleaning and its officers, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of our services or website; (b) your violation of these Terms or any law; (c) your property or the condition of your property; (d) your negligence or willful misconduct; or (e) any dispute between you and a third party related to our services.

11. Disclaimer of Warranties

OUR SERVICES AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR SPECIFIC EXPECTATIONS. YOU USE OUR SERVICES AT YOUR OWN RISK.

12. Insurance and Workers' Compensation

We maintain appropriate business insurance as required by law. For claims related to property damage or personal injury caused by our negligence, you must notify us promptly and cooperate in the claims process. Our insurance applies only to covered claims and subject to policy terms and limits.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, government actions, war, terrorism, labor disputes, power outages, or severe weather. In such events, we may suspend or reschedule services without liability.

14. Termination

We may suspend or terminate your access to our services at any time, with or without cause or notice, including for breach of these Terms, nonpayment, abusive behavior, or for any reason we deem appropriate. You may discontinue service at any time subject to our cancellation policy. Upon termination, you remain liable for any unpaid amounts and obligations incurred before termination.

15. Modifications

We may modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Material changes may be communicated via email or website notice. Your continued use of our services after changes constitutes acceptance. If you do not agree to modified Terms, you must stop using our services.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from or related to these Terms or our services shall be resolved exclusively in the state or federal courts located in Collier County, Florida, and you consent to personal jurisdiction in such courts. You waive any right to a jury trial and any right to participate in a class action. We encourage you to contact us first to resolve any dispute informally before initiating formal proceedings.

17. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreements or confirmations, constitute the entire agreement between you and Purple Cleaning regarding our services and supersede all prior communications and agreements. No waiver of any term shall be deemed a continuing waiver or waiver of any other term.
